Vermont Medical Record Retention Law:

  • * There is no specific retention period required in Vermont law for medical professionals. There is a requirement for hospital records, but that is different from providers.
  • * The provision specific to our licensee’s obligation to keep records is in 26 V.S.A. § 1354(a), which makes the following a form of unprofessional conduct: (10) failure to make available promptly to a person using professional health care services, that person’s representative, succeeding health care professionals, or institutions, when given proper written request and direction of the person using professional health care services, copies of that person’s records in the possession or under the control of the licensed practitioner

You can be charged either a flat $5.00 fee or $0.50 per page, whichever amount is greater, for obtaining copies of your health care records.

Itemized Bill:
The custodian (the entity holding your health records) must provide you with an itemized bill detailing the charges.

No Charges for Specific Requests:
Social Security or Needs-Based Benefits:
You cannot be charged for copies of health care records if the request is made to support a claim or appeal under the Social Security Act or any federal or state needs-based benefit or program.

Special Formats (e.g., X-rays, Films):
Reasonable Fees:
If your records include items like X-rays, films, models, disks, or tapes, the custodian may charge a fee that reasonably reflects the costs associated with providing these copies.
