- * Medical records shall be retained a minimum of five (5) years beyond the date the patient was last seen or a minimum of three (3) years beyond the date of the patient's death.
- * Records of newborns or minors shall be retained three (3) years past the age of majority.

Healthcare providers can charge for copying medical records, with specific fees depending on the format and type of record requested.
* For paper copies, the cost is $0.50 per page, plus a $20 base fee for requests by attorneys or insurance companies.
* Digital records can be provided at $0.30 per page, with a maximum charge of $200.
* Providers must offer records to patients at no cost for searching and retrieving. Different rules apply for psychological or mental health records and for certain government agency requests.
* Each printed x-ray, other photograph, or image costs $15 plus $20 per CD/DVD or other electronic media that it is provided on.
* The medical provider may also charge $15 for certified records.
