Maine Medical Record Retention Law:

  • * Adults: Minimum of 6 years recommended; 7 years required for hospital-based practices.
  • * Minors: Until age 21 generally recommended; until age 24 required for hospital records in Maine.

 

Cost

Up to $5 for the first page.
$0.45 for each additional page.
The maximum charge for the entire medical record is capped at $250.

Payment Requirements:
The hospital may require payment before responding to the request.

Charges for Electronic Copies:
If a medical record exists in a digital or electronic format and an electronic copy is requested, the hospital must provide it, provided it is reasonably possible to do so.

The hospital may charge for:
The actual staff time needed to create or copy the record.
Necessary supplies and postage.

Restrictions on Costs:
Retrieval of records.
New technology.
Maintenance of the electronic record system.
Data access or storage infrastructure.

Maximum Charge: The total charges for an electronic copy may not exceed $150.
