How long records must be kept

Adult patients
At least 5 years.
Patients who were minors
Records of ANY person under 23 may not be destroyed at all, whatever the 5 years would otherwise allow.
Clock starts
Receipt or production of the records.
Also
A longer period applies where federal law requires one.
Also
The duty runs on the CUSTODIAN of the records, not only the treating provider - so it transfers with the records.
