- * Medical records must be retained for at least 5 years after their receipt or production, unless a longer period is mandated by federal law or other regulations.
- * A custodian of health care records shall not destroy the health care records of a person who is less than 23 years of age on the date of the proposed destruction of the records. The health care records of a person who has attained the age of 23 years may be destroyed in accordance with this section for those records which have been retained for at least 5 years or for any longer period provided by federal law.

1. Free Copies for Claims or Appeals:
Initial Request: A custodian of health care records is required to provide a copy of any records necessary to support a claim or appeal under the Social Security Act or other federal or state financial needs-based benefit programs without charging a fee. This is applicable when the patient, or a representative with written authorization, makes the request and provides documentation of the claim or appeal.
2. Charges for Additional Copies:
Second Copy: If a second copy of the records is requested to support the same claim or appeal, the custodian may charge a fee:
Photocopies: A fee of up to 60 cents per page for photocopies.
X-rays and Similar Records: A reasonable cost may be charged for copies of X-ray photographs or other records produced by similar processes.
Prohibited Fees: No additional administrative or service fees can be charged for providing such copies.
