Michigan Medical Record Retention Law:

- * Records must be retained for a minimum of 7 years from the date of the service.
- * Exception- Records Involving Vaginal or Anal Penetration:
Extended Retention:
These records must be kept for a minimum of 15 years from the date of the service unless they pertain to one of the following exceptions:
1. Services Related to Specific Health Areas: Medical services primarily involving urological, gastrointestinal, reproductive, gynecological, or sexual health.
2. Emergency Services: Services associated with a medical emergency where there is an immediate threat to life or physical health, based on the licensee's good-faith medical judgment.
3. Rectal Drug Administration: Services performed for the rectal administration of drugs or medicine.
4. Temperature Measurement: Services performed to measure a patient's temperature.

$20.00 per request for a copy of the medical record.
Fees for Paper Copies:
$1.00 per page for the first 20 pages.
$0.50 per page for pages 21 through 50.
$0.20 per page for pages 51 and over.
Non-Paper Medical Records:
If the record is in a format other than paper, the charge will be the actual cost of preparing a duplicate.
Postage/Shipping Costs:
Any postage or shipping costs incurred by the provider in sending the copies may be charged.
Retrieval Costs for Older Records:
The actual costs of retrieving records 7 years old or older that are not maintained or accessible on-site may be charged.
A medically indigent individual is limited to one free set of copies. Additional requests for the same records will be subject to the regular fees.
