Maryland Medical Record Retention Law:

  • * Must keep medical records, laboratory, and x-ray reports for at least five (5) years from the date the record or report was created.
  • * For Minors- Must maintain and cannot destroy a medical record, laboratory, or x-ray report until the patient reaches the age of majority (18 in Maryland) plus three (3) years – in other words, until the patient is 21 years old, or for five (5) years after the record or report is made, whichever date is later.

* A fee for copying not to exceed .76 cents for each page of the medical record. * The actual cost of postage and handling.

* Preparation fee of $22.88, if the records are sent to another provider. The federal HIPAA regulations do not allow a charge for a preparation fee for records provided directly to the patient.

* No charge for medical records “that will be used for the purpose of filing a claim regarding or appealing a denial of Social Security Disability Income or Social Security Benefits under Title II or Title XVI of the Social Security Act” Code of Maryland, Health–General § 4-304(c)(5).
